gavel_and_judge.jpgTALLAHASSEE, Fla. (AP) _ An appellate court is ordering the Florida Commission on Human Relations to consider a handicapped man's complaint against an Orlando hotel.

A three-judge panel in Tallahassee on Friday said the commission erred when it dismissed the complaint without determining if there's reasonable cause to believe a discriminatory practice occurred.

The commission instead dismissed Kevin McGuire's complaint against the Peabody Hotel Group because it lacks jurisdiction to enforce the federal Americans with Disabilities Act.

The 1st District Court of Appeal panel, though, says the commission instead should consider the complaint under a state law that forbids discrimination in places of public accommodation.

McGuire alleged he made reservations for a wheelchair-accessible room but none was available when he arrived at the Peabody Orlando in June 2010. He then went to another hotel.
