TALLAHASSEE, Fla. (AP) – A Florida appeal court has rejected another challenge to an amendment that gives property tax breaks for primary homeowners.
The 1st District Court of Appeal cited its rulings in three prior cases Monday.
The lawsuit was filed by out-of-state residents who own second homes in Florida.
They do not qualify for the tax breaks provided by Florida Constitution through the Save Our Homes Amendment that took effect in 1995 and Amendment 1 that was effective in 2008.
Amendment 1 includes a portability provision letting primary homeowners take Save Our Homes benefits with them when moving to another home.
The Florida Supreme Court also has denied appeals in two of the prior cases.
